City of Sand City Ordinance No. 20-02 is an uncodified ordinance through which a development agreement between the City of Sand City and DBO LLC No. 30 is approved.  The purpose of the Development Agreement is to provide for the orderly development of an approximate 10.64 acre area bounded by Tioga Avenue in Sand City to the northeast, California Avenue to the southeast, East Avenue to the southwest, and the Merle Street right-of-way to the northwest in the central portion of Sand City, affecting Assessor’s Parcel Numbers (APNs): 011-122-002, -003, -004, -005, -010, -011, -023, -024, -025, -026, -032, -038, -039, -040, -041; 011-123-001, -004, -005, -006, -007, -008, 009, -011, -022, -024, -025, -026; 011-134-011; 011-135-001, -014, -015, -016, -023, -024; 011-136-007, -012, -024; and 011-186-021, -038, -039 (“Project”).

The Project includes both a hotel and three residential structures.  The hotel is intended for a maximum of 216 guest room at a maximum of four (4) floors with guest amenities. The residential portion of the Project is comprised of: (1) a single 5-story residential structure atop a partially underground 2-level podium parking structure for a total of 7-stories not to exceed 85-feet in height and providing 125 dwelling units and a rooftop restaurant; and (2) two additional detached 5-story residential structures providing a cumulative 231 dwelling units.  The Project includes courtyards, swimming pools, indoor club areas, park easements for public use, and a 3-story residential parking structure.  The Project will require the abandoning the City rights-of-way of Afton Avenue, Fir Avenue, and Orland Avenue in their entirety and a segment of Beach Way, relocating East Avenue, and creating a new street named “Morgan’s Way”.  The Project also requires the demolition of blighted light industrial and heavy commercial buildings and several dilapidated and vacant residential buildings.  Public improvements will include the completion of new public streets and rights-of-way, bike lanes, public parking, utility and infrastructure installation.

Findings in support of the development agreement are set forth in the text of the ordinance.  The development agreement, including full legal descriptions of the affected parcels is attached to the full text of the ordinance and available through the City Clerks’ office in City Hall at 1 Pendergrass Way, Sand City, CA 93955.  Ordinance 20-02 shall take effect on November 20, 2020.  This ordinance was passed and adopted by the following vote:
